ARTIST AGREEMENT FOR ICE Event Services, LLC

This document constitutes an agreement between ICE Event Services, LLC, its’ subsidiaries, principals, employees, independent contractors, affiliates and assigns(herein known as the “Company”) and (herein known as the “Artist”) for makeup, hair, and tanning services (collectively “Imaging Services”) at scheduled events on behalf of the Company.

Pursuant to the Company’s sole discretion, Company may schedule the Artist to provide Imaging Services at pre-selected fitness competitions, bodybuilding shows, and bikini competitions (“Shows”). Each service provided by an Artist on behalf of the Company shall exhibit the best practices within the industry, which include scheduling of appointments; prompt and professional attendance of the client’s appointment and ensuring that the Company’s final product meets or exceeds industry standards for the resulting show.

Company agrees provide management services for the Artist, which shall include, but not be limited to promoting and advertising the Artist’s services, scheduling and paying for all reasonable travel for the Artist if the venue is in excess of 60 miles outside the Artist’s home residence; and receive and confirm payment and schedule Image Services purchased by 5pm the Wednesday preceding any show, and provide the schedule to the Artists by 5pm the Thursday preceding any show.
Artists agree to abide by the following rules and regulations as it relates to the Company, their mission, and their clientele:

  • Artists are required to sign a confidentiality agreement with ICE Event Services, LLC, and are prohibited to discuss ICE and their affiliates, services, policies, or proprietary information with the clients, other artists,or the general public. Artists must commit to the shows they will work, and cannot cancel their attendance within 30-days of any scheduled show. Should the artist cancel their attendance at the show, they will be responsible for any fees and damages incurred by the company.
  • Artists may only work for ICE Event Services, LLC during an event and cannot book or schedule any freelance appointments or services.
  • Artists will receive their show appointment schedule no later than the Thursday prior to the scheduled show.

Uniforms:

Artists will wear a set uniform as defined by the Company, and is subject to change. The current uniform consists of a fierce military meets Glam look. Artists will wear the following:

  • ICE Event Services T-Shirt (provided by Company)
  • Solid Black Leggings or Jeans
  • Black Shoes, heels or boots

Artists must also have complete hair and makeup in a style pre-approved by the Company and must be ready for clients at least 20 minutes prior to the first scheduled appointment. Hair must be groomed – up or down. Makeup must include lashes.

Room Setup (Hair/Makeup Appointments): Hotel room or venue

The Artist must prepare the room to receive clients, and keep it presentable, welcoming, clean and professional at all times. Artists are required to have the room ready and to personally be ready for their first client a minimum of 20 minutes prior to their first scheduled appointment.
Further the artist must have the following completed:

  • Curling Iron and/or Straighteners must be plugged in
  • Makeup must be ready and accessible
  • Beds must be made
  • Bathrooms must be clean
  • Proper lighting set up and on
  • Upbeat Top 100 Hits in the background (No cursing in music… use today’s hits with volume low).
  • Working space is clean and organized at all times.
  • Room of service must look presentable, clean, and professional at all times. Room Setup (Tanning): Designated Room or Venue

As with the makeup and hair appointments the tanning room must be presentable and ready to receive clients at all times.

Setup for the tanning area must be completed one hour before the first client is scheduled. All tanning services are completed the day before the show. No walls, furniture, floor space may be left uncovered.

Company will provide wall tarps, floor tarps, wall tape, duct tape, scissors, spray tents, spraying machine, spray guns, extensions cords, fans, spray tan solution, gloves, masks, buffers, paper towels, lotion, drop pads, shower caps, baby wipes, bikini bite and glaze to the Artist for the tanning appointments.

The artist must be in the room and ready for their first client 20 minutes prior to their first scheduled appointment.

Manner of Conduct/Attitude:

Artist is an Independent Contractor and a representative of the Company and should maintain a pleasant demeanor and attitude, exhibit professionalism, and display a conduct that is exemplary and hospitable. All clients should be treated with respect, professionalism, friendliness, and the highest level of customer service.

Artists will not speak negatively about other clients, athletes, artists, the Company, competition, or anything related to the show or shows. Complaints by clients regarding Artists may be cause for removal of Artist from rotation of scheduled shows and assignments or result in immediate termination from representing the Company in any manner, shape or form.

Photographs:

Prior to providing Imaging Services, Artist is required to politely ask clients if they may have permission to take the client’s picture or photograph to be used in future promotions, marketing, and advertising, including, but not limited to, online social media outlets. (For ICE Makeup and Hair clients, not Tanning clients), and if the client consents, have the client sign a photograph/video release and waiver where appropriate.

Execution of Services Hair & Makeup:

Artists should listen to the client’s requests but also guide them as to what looks best for the stage at the time of the appointment.

Artists are to complete the services as paid by the client.

Individual services are scheduled in 30-45 minute time slots and artists are encouraged to abide by the times provided. Clients receiving hair and makeup services together will have (2) 30-45-minute slots scheduled together. If the Artist is behind schedule they will contact the remaining client list and update their appointment times.

If a client has paid for a straight hair appointment and requests their hair to be curled, or extensions to be added, explain the additional fees and appropriately charge the client any additional amounts before proceeding to provide the additional services requested by the Client.

Reminders:

  • Be sure to stay on time with your appointments.
  • Double check what each client has paid for, as there are different prices for different hair services.
  • Makeup services cover all aspects of their makeup application, including false lashes.

Following the completion of the final service, artists may begin to break down the room. Note, this includes the final full or partial makeup application prior to finals.

Artists must stay to assist breakdown/cleanup of the entire ICE workspace & to assist Tanning Artists backstage with any required touch ups and glaze.

Artists are required to provide the following items for makeup and hair services:

  • Skin moisturizer
  • Face/Eye/Lip primer
  • Professional Foundation
  • Professional Makeup Kit
  • Eyeliner (Maybelline Eye Studio Eyeliner – Blackest Black)
  • Eye Brow Pencil – light & dark brown
  • False Eyelashes
  • Mascara
  • Lipstick (Reds/Pinks)
  • Lip Gloss
  • Makeup brushes
  • Makeup wipes
  • Hair clips
  • Curling Iron
  • Flat Iron
  • Brushes & Combs
  • Bobby Pins
  • Hair Spray (to be purchased on sight if flying to location)

Tanning:

Tanning services purchased include an unlimited amount of tanning coats the day prior to the show and at prejudging. Artists should remind clients that the color will continue to develop overnight and will get muddy if too many coats are sprayed at once.

The first spraying is always the day before a show, usually Friday, and since the room must be set up the day before the first scheduled appointment, tanning artists are expected to arrive 1-day before the show.

Spray tanning room setup must be completed one hour before the first scheduled service by covering the room head to toe with protective tarps and other materials. It is strictly prohibited that any walls, carpet or furniture be left uncovered prior or during the providing of Imaging Services!

Spray tanning on the date of the show will only be available at the venue and it will be set up before the show meeting begins and available until Finals begin located backstage.

Setup materials at the venue include the wall tarp, wall tape, a spray tent, spray machine, spray gun, tanning solution, cleaning solution, gloves, buffers, masks, bikini bite and glaze.

Breakdown of the spray tanning room will be done after all clients have been sprayed that day and services are completed. This can be completed halfway through finals. Artists MUST stay to the end of finals.

Spray tanning must be offered to any “Guest Poser” at the show. Guest poser will be identified prior to show beginning.

Reminders:

  • Clients have purchased unlimited coats, glazing and touch up services for both prejudging and finals on the day of.
  • At select shows EVERY competitor will be touched up and glazed before they hit stage
  • At large shows, all ICE clients will be touched up and glazed before they hit the stage, all non-ICE clients will be charged a fee.
  • Be sure to stay on time with your appointments.
  • Breakdown of the venue can only be done after the last client has been glazed.

Client Purchases:

Client purchases are NON-REFUNDABLE and only transferable to select shows.

All services must be paid for in full prior to receiving service. If the client desires extra service, payment confirmation of the extra service must be purchased online and shown to the Artist or purchased the day of service through the Ice Manager on duty.

If the Artist fails to receive payment for an additional service, Artist will not be paid for additional services rendered.

If a client demands a refund for services rendered, they must first contact ICE Manager on duty. Refunds will be issued at the discretion of the Company. Artists will not be paid for any services that are reimbursed due to the fault of the Artist.

Clients may purchase full or partial makeup applications for Finals. A partial application consists of either the eyes only, or the face application (not including the eyes). If the Artist deems that a full application is required, they must have the client pay for the additional service prior to receiving the work.

Clients may also purchase a hair touch-up. If the client wants their hair to be redone completely, they must pay for a full service.

Travel Arrangements:

The Company will cover the reasonable and pre-approved costs for all flights and lodging during the scheduled events. Reasonable transportation from the airport to and from the host hotel is also covered by the Company. Should the Artist choose to stay beyond the scheduled time agreed to and paid by the Company, the Artist shall be solely responsible for any additional lodging fees at their expense.

Artist is responsible for all personal incidental costs and any damages to property incurred during appointment times. Any incidental fees for room damages, use of television, Wi-Fi, minibar, room service, movie channels/pay per view content, telephone, etc., are the sole responsibility of the Artist.

Artists are responsible for their own transportation to the airport for their travel to and from home.

Artists are responsible for all airline add-on fees, including but not limited to luggage fees, seat upgrades, plane changes, priority seating, curbside baggage assistance, tips, etc. A checked bag will be included for trips that are longer than 3 nights.

Should an Artist travel to a show via their own vehicle instead of flying, the Company will reimburse the Artist for mileage at a rate of $0.67 per mile, or for gas (not both), for all miles OVER 150 (75 miles each way). Parking at the host hotel will be reimbursed on case by case review. Tolls will not be reimbursed. Artists will electronically transmit accurate copies of applicable receipts and mileage reports along with their request for payment (invoice) for services rendered by the Sunday after the most recent show.

The Company will secure travel arrangements allowing for sufficient time for the Artist to arrive and set up the tanning space for a show, and subsequently a substantial rest period following the close of the show. The company will not book any travel on the same night of the show without the Artists expressed consent. Artist assumes all liability for not taking a mandatory rest period from performing duties and returning for their travel home.

Artist Payment

The Company in accordance with the following schedule below will pay artists. Artists are required to submit a report of all appointments, pictures, photography releases, and expenses no later than Sunday immediately following the show they attended to the Scheduling Manager at the Company, currently using email info@icetanningmakeup.com.
Payment to the Artist will be within 30 days of the event. For a show to be reconciled, all reports must be submitted, client surveys sent, and no outstanding client concerns remaining.

Payment Schedule:

The Company has the right to change this payment schedule with proper notice to the Artists.

  • MASTER ARTIST – HAIR & MAKEUP
    • $500 Flat Fee Per Show + $10 Restock Fee Per Client
  • TANNING SERVICES:
    • Tanning staff is paid $250 Per Day Per Show.
  • TIPS:
    • Clients may choose to tip makeup and tanning artists for services rendered. Tips will be kept in a universal tip bucket and distributed EQUALLY by the Ice Manager on duty.

WAIVER & RELEASE:

I, the Artist, for myself and my heirs, executors, administrators and assigns, hereby release, waive, discharge and hold harmless, ICE and its successors, assigns, directors, offices, employees and agents from any and all liability, claim and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services I provide on behalf of ICE and travel on behalf of ICE.

I understand and expressly acknowledge that I am an independent contractor and not an employee or partner with ICE, and therefore expressly waive any and all rights at law or equity as an employee, whether in state or federal law, pursuant to any workers compensation or employee liability legal requirements.

I understand and acknowledge that this Release discharges ICE from any liability or claim that I may have against ICE with respect to bodily injury, personal injury, illness, death, property damage, or any other claim that may result from the services I provide to ICE or occurring while I am providing services, whether at the hotel or venue or in transit to or from the venue.

Insurance: Further, I understand that ICE does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, worker’s compensation, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of ICE beyond what may be offered freely by ICE in the event of injury or medical expenses incurred by me.

Medical Treatment: I hereby release and forever discharge ICE from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergence during my tenure as an Independent Contractor with ICE.

Assumption of Risk: I understand that the services I provide to ICE may include activities that may be hazardous as I work with chemical compounds, including, but not limited to tanning solutions, make-up products, hair products, and other substances that may have a negative effect on my health for prolonged use, failure to wear proper equipment, or failure to disclose allergies, medical conditions, or pregnancies. As an Independent Contractor, I hereby expressly assume risk or injury or harm from these activities, agree to take all reasonable and prescribed precautions pursuant to product safety as instructed by the product’s manufacturer,  and release ICE from all liability therefrom.

Other: As an Independent Contractor, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida and that this Release shall be governed by and interpreted in accordance with the laws of the State of Florida with any and all venue and jurisdiction exclusively in the state and federal courts located in the State of Florida, city of Orlando, and County of Orange with the requirement that in the event of a dispute, such dispute shall be initially sent to mediation and thereafter exclusively to binding arbitration pursuant to the prevailing rules and regulations of the American Arbitration Association. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

By signing this agreement, the Artist and Company agree to all terms as stated herein. This agreement may be modified at any time with the consent of both parties. This agreement shall be binding upon ICE Event Services, LLC, BSF Productions, Bombshell Fitness, LLC, the Artist, their successors, heirs and assigns shall be enforced under the laws of the State of Florida.
